marijuana-and-prescription-drugs-300x189-300x189Officials from the Holmdel Police Department recently arrested two men who are now facing charges for numerous drug crimes after a search at a local residence revealed marijuana, prescription drugs, and drug paraphernalia.

According to a statement released by the Holmdel Police Department, police executed a search warrant at a residence located on Dogwood Court in Holmdel on June 3rd. During the search, investigators seized marijuana, drug paraphernalia, and prescription drugs, at which time they arrested Jonathan Diaz and Tyrone Spann.

Diaz is now facing charges for possession of a controlled dangerous substance (CDS), possession of prescription drugs, distribution of a controlled dangerous substance (CDS), possession of marijuana, and possession of drug paraphernalia. He was being held at the Monmouth County jail in lieu of bail set at $50,000.

As for Spann, he has been charged with distribution of marijuana, possession of drug paraphernalia, and being under the influence of drugs. He was being held at the Monmouth County in lieu of bail set at $35,000.

In terms of the penalties to which these defendants are exposed, they will vary based on the specific drug offense and the amount of the substance associated with the crime. For example, New Jersey law outlines distribution of marijuana offenses in section N.J.S.A. 2C:35-5 of the New Jersey Criminal Code. The degree of these charges is determined by the measured weight of marijuana or the number of marijuana plants involved in the specific offense. As a result, penalties can range from 18 months in New Jersey State Prison (for less than 1 ounce) or up to 20 years (for 25 pounds or more or 50 or more marijuana plants).

When you are charged with a drug crime in New Jersey, it is essential to understand the nuances of the specific charges against you. The degree of the charges, the burden of proof placed on the State, associated issues with search warrants, probable cause, and other important factors will significantly influence your defense strategy, available legal options, and the sentence imposed if you are ultimately found guilty.
